Terms and Conditions for Krysta Lanier Art

• Engaging in any conduct that could be considered unlawful, defamatory, harassing, abusive, or otherwise objectionable.

4. Intellectual Property

• Artwork: All artwork displayed on the Website, including but not limited to paintings, drawings, prints, and digital art, is the intellectual property of Krysta Lanier and is protected by copyright laws. Purchase of artwork or prints does not transfer copyright or reproduction rights to the buyer unless explicitly stated in a separate written agreement. You may not reproduce, distribute, display, or create derivative works of the artwork without the express written permission of Krysta Lanier.

• Website Content: All other content on the Website, including text, graphics, logos, images (excluding the artwork itself), and software, is the property of Krysta Lanier Art or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute any content from the Website without our prior written consent.  

5. Purchases and Payment

• By placing an order through the Website, you are offering to purchase the products selected based on these Terms. All orders are subject to acceptance by us.

• Prices for artwork and other products are displayed on the Website and are subject to change without notice.

• You agree to pay the full purchase price, including any applicable taxes and shipping fees, as indicated at the time of purchase.

• Payment processing is handled by third-party payment processors. You agree to abide by their terms and conditions as well. We are not responsible for the security or performance of third-party payment processors.

• We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspicion of fraudulent activity.  

6. Shipping and Delivery  

• Shipping costs and estimated delivery times will be provided during the checkout process.

• We will use reasonable efforts to ship your order within the timeframe indicated. However, we are not responsible for delays caused by shipping carriers or other factors beyond our control.

• Risk of loss and title for purchased items pass to you upon our delivery to the shipping carrier.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE WEBSITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR THE APPLICABLE PRODUCT OR SERVICE.

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. You agree that any legal action or proceeding between you and Krysta Lanier Art for any purpose concerning these Terms or the Website shall be brought exclusively in the federal or state courts located in Georgia.
